Counterpoint: Why A Conservative Backs Term Limits

Afterfleischman Calbuzz posted Bob Naylor’s piece last week on why conservatives ought to oppose term limits, our friend Jon Fleischman at the Flashreport asked for an opportunity to tell Calbuzzers why a conservative might want to be for them. Although we’ve argued that term limits are one of the structural impediments to making California governable, we thought we’d give Jon a chance to argue otherwise to our readers.

When I first got involved in politics, at the age of nearly 20, I remember traveling to the Capitol and meeting and seeing a lot of state legislators.  The most overwhelming thought that I carried away from that first trip was the realization that a whole lot of them had been serving in the Legislature since before I was born.  I remember, along with so many others, looking with awe at Speaker Willie Brown, who was as close to king as you could get in California.  And I remember being repulsed at a political process that could place so much power in the hands of one of 80 members of the California Assembly.

As I became a little more seasoned politico, it became obvious to me that the Legislature was completely out of touch with the “real people” of California.  And while I knew term-limits would not solve all of those problems, I supported Proposition 140 in 1990 because there should never be a phenomenon like we had with Willie Brown again – California royalty.

I certainly agree with Bob Naylor who penned a column for CalBuzz last week, that there are a lot of problems with the state Legislature. But I disagree entirely that these problems are as a result of term limits.

If you want to look to some of the reasons why our Legislature is broken I suggest we look a few of the major contributors to that dysfunction.

•    The legislature should be part-time, not full-time.  There would likely be less allure to serving for decades in the legislature if serving were not a full-time job.  In addition, the full-time legislature becomes “the Devil’s workshop” as so many politicians justify their full-time salaries through the creation of thousands and thousands of unnecessary pieces of legislation every year, over-legislating and over-regulating our state.

•    The gerrymandering of the state’s legislative districts to advantage the majority party is nothing short of scandalous, and certainly has led to a Legislature that is out of touch with the people of the state (witness this last May’s rejection of more taxes as a recent example).

•    With the massive population of California, legislative districts have become too large.  California State Senators represent substantially larger districts than members of Congress!  With districts so large, it makes it that much more difficult for legislators to be held accountable to their constituents.

•    Then there is the issue of the insane money advantage for incumbents.  On an overwhelming level, the money that is contributed for candidates running for the Legislature comes not from average citizens with a strong interest in seeing good, ordinary people like themselves represent them in Sacramento. Instead the money that funds campaigns for Democrats and Republicans alike mostly comes from special interest groups that seek to manipulate state laws and regulations to their advantage –- interests ranging from public employee union and trial lawyers to major corporations.  Add to this that the major political parties routinely support incumbents of their party for re-election, supplying even more resources contributed to the parties by those same special interests.

Clearly term limits alone as a reform cannot offset these four major problems plaguing the Legislature. But I would submit they play a positive role in ensuring that power in Sacramento does not become centralized in the hands of career politicians like some of the people that Bob holds out in his piece as examples of great legislators – such as “King” Willie Brown himself.

I agree that the more time spent in the Legislature, the more experience one has. But this advantage is more than offset by the growing detachment of career politicians from the “real world,”  and the absence of a need to live under the laws they create.

In his column, Bob Naylor asserts that, “If a legislator has mastered the political art well enough to deserve another term, the people of that district should have the right to grant it.”

That sounds nice in print, but as a practical matter, because of all of the factors I outlined above, it is almost impossible, short of a scandal, to find examples of incumbent officeholders losing their campaigns for re-election.  In fact, if it were not for term-limits, we would return right back to the pre-Proposition 140 era – with legislators serving for more than 30, 30 or even 40 years – safely ensconced in taxpayer supplied jobs, never having to worry about the impacts of the laws their create on the economy in which they would need to find a job after leaving the Legislature.

The challenger to an incumbent officeholder faces almost an impossible task in a general election. And good luck trying to unseat a legislator in a primary.  It is only the existence of term limits that ensures that every eight years in the Senate, and every six years in the Assembly, there will be an open seat and an opportunity for the voters to have a real impact on their representation in Sacramento.

Term limits exist today because the people do not want a state Legislature that is “above them” – but rather they want elected officials that are “from them” – their co-workers, their neighbors, their friends from church or temple.  It was the era of full-time legislators that brought us campaign slush funds, lavish pensions and the trappings of “royalty” that made it clear that those long-time politicians had lost touch with the people they were supposed to represent.

Bob says that he would favor returning to a system without any term limits – invoking the model of the Founding Fathers.  I have no doubt that if those brave first Americans could have seen that our federal government would grow so grotesquely in size and scope, and that serving in the Congress would become a lifetime career with great pay and outrageous benefits, they would have instituted term limits in the United States Constitution.

When California has a part-time legislature, smaller and fairly drawn legislative districts, and we have figured out how to increase the political giving of regular citizens to a degree that it severely reduces the terrible influence of those seeking advantage from government – then I will entertain a serious discussion about whether the need for term limits remains.  Until then, I would much prefer a steady flow of citizen-politicians in and out of the Legislature than a return to the days of elected California royalty.  Based on the failure of all of the attempts to eliminate or weaken California’s legislative term-limits, apparently I am not alone.

How May 19 Election Is Just Like “Rashomon”

rashomonbwGov.  Arnold began his budget speech to the Legislature Tuesday with a touch-all-the-bases analysis of the meaning of the May 19 special election.

“That message was clear,” he said. “Do your job. Don’t come to us with these complex issues. Live within your means. Get rid of the waste and inefficiencies. And don’t raise taxes.”

Well, two out of five ain’t bad.

Schwarzenegger’s opening line was just the latest effort by California politicians of almost every stripe to overreach and over-interpret the Just-Say-No votes on Propositions 1A-1E in the dismal turnout special.

Since May 19, the foregone election results have become like the crimes at the center of “Rashomon,” the famous 1950 Akira Kurosawa film, in which the same incident is described – in mutually contradictory ways – from four different subjective perspectives.

As a political matter, however, conservative Republicans have been extremely successful in selling their version of events. In dominating the fight to frame the narrative about May 19, they’ve not only pushed Schwarzenegger back into paddle-to-the-right, no new taxes mode, but also apparently intimidated majority Democrats (including even Dianne Feinstein back in DC) into buying into or fearing to protest their predictable, antediluvian interpretation.

So on the one hand the California Republican Party boldly declares that the election sent a “national anti-tax message,” and our friend John Coupal, president of the Howard Jarvis Taxpayers Association, insists that “voters were crystal clear in statement about their tax burden.” And on the other hand, it’s left to former liberal lawmaker Sheila Kuehl, who argues voters were saying Sacramento shouldn’t “keep balancing the budget on the backs of average Californians” and Democratic poll taker David Binder, who says voters actually favor some tax increases over cuts in education and other programs, to make the case on the other side.

How about this, Calbuzzers? There was one and only one overarching message from the overwhelming majority of voters who DIDN’T EVEN BOTHER TO SHOW UP: Work it out among yourselves and stop bothering us. (On this point we agree with Arnold’s analysts.)

As we wrote on the morning of May 20 the election was “a clear signal that voters are way beyond fed up with half-measures, marginal fixes and smoke and mirrors in Sacramento.” And the plain fact is that all the over-wrought interpretation of the May 19 results since then is little more than spin, propaganda and self-interested commentary.

Let’s look at the facts:

* The latest voter turnout number reported by the Secretary of State shows that 27.5 percent of the 17,153,012 registered voters (or 20 percent of those eligible) bothered to show up, which hardly scores as a broad-based populist message about anything beyond the fact that they found the ballot props incomprehensible.

* While the Sacramento establishment poured millions into passing the props, much of the money spent against them came from normally Democrat/left constituencies, like SEIU and CFT. The fact that these groups got into bed with anti-tax Republicans, normally their mortal enemies, shows that the resounding “No” vote had multiple roots and represented anything but a “clear” — let alone “crystal clear” fercryin’outloud — message about anything.

* Binder is the only guy who has anything remotely resembling quantitative data on the special. His close ties to Democrats and labor give those on the right an excuse not to even look at his research on what was on voters’ minds. But, as Binder wrote, it shows that voters surveyed before and right after the election “do not trust the leadership in Sacramento, and recognize that the failed special election was just another example of the inability to bring real solutions to voters.” And, as the pre-election Field Poll found, voters favor a blend of cuts and taxes to address the deficit. (The key here, of course, is that they want taxes that affect someone else – tobacco, oil royalties, the very wealthy, for example.)

It is an abiding mystery why wussy, wimp Dems have so passively allowed knuckle-dragging Reeps to seize control of the narrative. That aside, the over-interpretation of May 19 has gotten plain silly, and it’s well past time to throw a yellow flag.

Let’s be crystal clear: Calbuzz isn’t making an argument for or against taxes, or for or against specific program cuts or anything else to do with policy. Our mission remains unwavering: to watch the battle safely from atop the hill, then swoop in bravely to shoot the wounded.

We’re just sayin’.

Stop the Presses: Boxer-Feinstein Prop Summit Collapses

boxerthumbupAll those voters who were waiting for guidance on the May 19th budget propositions from Senators Barbara Boxer and Dianne Feinstein had their hopes and dreams smashed to smithereens today, when Boxer went rogue and announced her support for Props. 1A and 1B.

During the California Democratic Party state convention, Boxer had ducked taking a stand on the biggest issue facing California voters, saying she and Feinstein would be studying the props to formulate a joint position. But with DiFi apparently still mulling the fine print, Boxer went solo.

“California’s budget process is broken,” Boxer announced. “It’s time for California to join the vast majority of states and reform the two-thirds requirement for adopting the budget.

“However, until we make this crucial reform, I will be supporting Propositions 1A and 1B on the May 19 ballot. These two measures will help get California back on track, while protecting our investment in education.”

What happened to the great Boxer-DiFi Budget Prop Study and Announcement, we asked Boxer’s campaign guru Rose Kapolczynski. “In the end, she decided to deal with the propositions independently. And with time short before the election, Barbara decided to issue her statement today,” Rose said.

Translation: Feinstein is still locked in debate with herself.

As highly trained observers, Calbuzz noted that Boxer did not take a stand on the rest of the propositions. “These are the ones she thinks are most important. These are the ones she feels most strongly about,” Kapolczynski said.

Why Voters Really, Really Hate the Budget Props

scream1The question in the new poll by the Public Policy Institute of California that best captures the state’s political zeitgeist is this:

“Would you say the state government is pretty much run by a few big interests looking out for themselves, or is it run for the benefit of all the people?”

The response of those surveyed was resounding and universal, regardless of party, gender, age, education, or whether they got a good night’s sleep: By virtually every measure, three out of four Californians believe that in Sacramento, the fix is in. Among likely voters, 76 percent say special interests dominate, the biggest margin since PPIC started breaking out data from this group on this question five years ago.

In other words, when ordinary people think of the Capitol, they see insiders skimming the financial and political cream, while they’re stuck on the outside looking in, noses pressed to the window.

In that atmosphere, it’s hard to imagine a more bone-headed scheme than Propositions 1A-1E that the Capitol’s political elites could have devised to convince voters to support the dead-of-night budget bail-out that Arnold and legislative leaders concocted back in February.

The measures may be -– as Calbuzzer Fred Keeley noted here back in March -– the best bad deal you’ll get. But a man from Mars, or even, say, New Jersey, who suddenly arrived in California and took a look at this special election collection of political detritus would be easily forgiven for thinking it was devised by a gang of alien con men, living in an alternate universe and addicted to speaking in acronyms and obfuscatory legal gibberish jargon.

Most media coverage of the props campaign (including here) has focused on the back and forth about tax increases versus program cuts, and its predictable, tit-for-tat ideological rhetoric. Forget that for a moment — take a step back and just look at these things through the eyes of a normal voter who doesn’t his spend his life poring through The Target Book and getting iPhone RSS feeds from the Leg Analyst’s office. Here’s you what you see:

1. The props were carefully crafted to avoid causing any pain or requiring any sacrifice by Sacramento’s heavyweight special interests.

While the governor’s initiatives would require a working stiff to pay more at the K-Mart checkout stand, at the DMV registration window and at the 7-11 lotto ticket counter, the oil, alcohol and entertainment industries, the mighty California Teachers Association and the Native American casino operators, among others, get a pass: in exchange they’ve ponied up millions to help Arnold pass the props.

Rich details of this dynamic were reported out in a recent piece of terrific investigative work by the indefatigable Shane Goldmacher, published in the Sacramento Bee, here and here.

“The entire architecture of the ballot pact that emerged was heavily shaped by leaders’ desire to please – or at least neutralize – the state’s most powerful political players,” wrote scoop artist Shane.* “Now, some of those very interest groups protected in the budget deal are bankrolling the campaign to ratify it.”

2. The props were written with stultifying complexity, the better to sell them to voters with simple-minded sound bites.

While you don’t necessarily need a graduate degree in physics to understand the May 19 measures, you damned well better know someone who does, and is willing to spend a couple hours walking you through the ballot’s differential equations.

In one of the most telling columns of the campaign, our grizzled friend George Skelton of the L.A. Times recounted how Schwarzenegger called him up to complain because he kept writing that Prop. 1A is complicated:

“It’s already complicated as it is,” the governor says, ’but the more you write about how complicated it is, the more complicated you make the complication.” “Explain it a little bit simpler,” he urges in a phone chat.

Ever a heroic solider in the daily war of words, Skelton performed a mighty yeoman effort to explain the damn thing as simply as possible, but was forced to conclude:

“Sorry, governor, Prop. 1A is complicated. It defies a simple explanation, especially when linked with a tax bill and school funding prop.”

This just in: The CTA, now bombarding the airwaves with Yes-on-1A-and-1B ads, doesn’t want the voters to bother their silly little heads with all those boring complications; so they put a teacher in their new ad to say that defeat of the two props “won’t hurt the politicians, just the students.”

3. The political perspective of the props has far more to do with inside-the-cul-de-Sac tactics and strategy than with the real lives of real people.

Thus, Capitol courtier scribes devote reams of column inches to admiring the inside baseball nuances of the props – e.g. Dan Weintraub on “Anti-tax activists miss the point of Prop. 1A” — than analyzing how the tax increases would affect the millions of Californians who’ve lost their jobs, or expect to, any day now; the little people, it seems, are just too simple to understand the deliciously Machiavellian subtleties of their political masters.

As a policy matter, the potential fall-out from the likely defeat of the major budget props – a state government cash shortage, unpaid vendors, poor and sick people missing benefit checks, cancellation of construction projects, public employee layoffs – will dramatically raise the stakes for coming up with a solution to the budget mess that voters find palatable.

Memo to the Big Five: There’s a lot of anger out there and more political fast talk and financial con games on your part is only going to stoke it. Weekend Flea Market: Lie Down with Dogs, Come Up with Items

blankface1Whither Tony V?: L.A. Mayor Antonio Villaraigosa’s abrupt cancellation of his appearance at the Democratic state convention, coupled with the consistent snarliness of his political handlers, has fueled speculation that Tony V. may not run for governor. But L.A. political insiders scoff at such gossip: “It looks like it’s going to be a Democratic year. If he doesn’t go now, in eight years he’ll be 66, and facing a whole new generation of young ‘uns,” said one savvy southland seer. “This is his shot.”

Still, local politicos are closely eyeballing the increasingly bitter brawl for city attorney between lawyer Carmen Trutanich and city councilman Jack Weiss as a measure of Villaraigosa’s strength. If Weiss, the mayor’s dog in this fight, loses on May 19, it will be one more bit of evidence, along with Tony’s unimpressive re-election numbers, that Antonio Alcalde’s standing with his political base ain’t all that.

Whitman Sampler: On the Republican side, Insurance Commissioner Steve Poizner stepped up his attacks on GOP front-runner Meg Whitman this week, issuing no less than three statements ripping eMeg variously for ducking debates, stiffing the press and sugarcoating her tenure at eBay.

Weirdest move by the Poizneristas was a press release reprinting in full an article written for Capitol Weekly by Democratic consultant Garry South, Gavin Newsom’s strategist. The piece was South’s take on the problems faced by rich business executives who jump into politics, an issue we posted about on Monday. In recounting how he tackled the wealthy businessman Al Checchi while handling Gray Davis for governor, South saw similarities with Whitman:

“Whitman shares yet another commonality with Checchi – a spotty voting record,” he wrote. “Whitman didn’t bother to vote in four statewide elections since just 2003 – including the ‘03 recall election that put Gov. Schwarzenegger in office. À la Checchi, she hasn’t been able to verify whether she voted in the 1994 gubernatorial election, when the controversial anti-immigrant Prop. 187 was on the ballot. She has apologized for these lapses, saying she was busy running a company and had two kids. (Average voters with kids use that as an excuse for skipping the polling place?)”

Whitman has remained sanguine in the face of near-constant sniping from various corners, apparently believing that the Republican primary is more than a year away… Oh, it is?

Be that as it may, by remaining silent in the face of Poizner’s pounding, eMeg runs the risk that the narratives her rival is setting down – she’s afraid to debate, she’s afraid of the press, she’s doesn’t understand state issues – take hold, at least among the cognescenti and the media. If that happens, she may find down the road that her orchestrated efforts to “introduce” herself to voters will be hampered by a need for rehab, to undo the definition frame Poizner plunked on her early (now, about that Calbuzz interview request, Meg…)

Lust in his heart: Tom Campbell, the third Republican in the race, keeps plugging away in his terminally earnest energizer bunny manner, trying to make the race about…issues, fercryinoutloud.

Campbell this week delivered a big guest lecture on economics at UCLA, in which he raised the specter of unintended consequences arising from Obama’s John Maynard Keynes imitation:

“The growth in federal borrowing over the last six months has been greater than at any comparable time in American history, by a large amount,” Campbell said. “When the economy recovers, inflation is inevitable. A modest estimate, given the amount of money the federal government has printed, is in excess of 12% inflation.

“That has a direct cost to California because of the huge amounts our state borrows,” he added. “No one will buy a California bond at less than the expected rate of inflation. So, as systemic double-digit inflation, dead since Jimmy Carter, returns to our national economy, the effect will be particularly devastating on California’s ability to balance its budget.”

Oy.

Puff, puff, bail, bail: Greg Lucas, Calbuzz Capitol Correspondent, blogs his take on the dust-up over legalizing marijuana, over at California’s Capitol. His bottom line — not bloody likely anytime soon:

“Expansion of sin taxes hasn’t fared well in the Capitol… Although possession of less than an ounce of marijuana is an infraction, lawmakers are reluctant to back legislation that could make them appear soft-on-crime, fearing campaign attack pieces. That would make legalization of marijuana that much more difficult.”

The long goodbye: Latest twist in the sad saga of newspapers twisting slowly in the wind was a Senate subcommittee hearing on “The Future of Journalism” this week; chairman John Kerry and other members of the World’s Greatest Deliberative Body defended ink-stained wretches against the likes of print-killers Arianna Huffington and Marisa Mayer of Google.

Washington Post class clown Dana Milbank had the most succinct report here while the strongest testimony was delivered by David Simon, former cop shop reporter for the Baltimore Sun who took on the decline of newspapers in season five of his superb HBO series, “The Wire.”

Freudian parts dept: One of Gov. Schwarzenegger’s many signature moments in “Terminator 2: Judgment Day” comes when he wields a giant tear gas launcher against a bunch of cops while escaping from Cyberdyne Systems: “It’s definitely you,” adolescent hero John Connor tells Cyborg Arnold.

Now, one day after the governor promised fire-weary Santa Barbara residents he would do whatever it takes to conquer the raging Jesusita blaze, local smoke eaters got the firefighters’ equivalent of Arnold’s Big Gun: a DC-10 air tanker, which made repeated sorties over the fire Friday, dumping 12,000 gallons of retardant in a single drop.

“Chill out, dickwad.”
